COPYRIGHT & EXCLUSIVITY
All copyright is wholly owned and reserved by Bluebelle Studio.
All designs are exclusive and original to Bluebelle Studio and are protected by copyright law. It is an offense to steal in whole or in part any of the designs, layout, copy or photography created by Bluebelle Studio. It is illegal to reproduce any item, text, copy, design or content without express permission from Bluebelle Studio. Modification and/or reuse of stationery for other occasions/uses is prohibited. Bluebelle Studio holds ownership and copyright on all designs whether custom or existing. Violations of copyright on any of our content including design, text, imagery or other will be vigorously pursued. Bluebelle Studio reserves the right to use custom-designed pieces for future themes/layouts.
Bluebelle Studio reserves the right to reproduce any part of any work produced by Bluebelle Studio for marketing purposes. Unless strictly instructed otherwise by a customer prior to placing an order, Bluebelle Studio reserves the right to use any design created for a customer as samples and can photograph this stationery for advertising in print, online wedding directories, across social media and throughout website galleries.
The items you are purchasing are exclusive to Bluebelle Studio. As such all stationery pieces will include a small unobtrusive copyright credit ‘©bluebellestudio.com.au’ printed on the back of the item. The credit is kept to a minimum point size and is positioned so as not to interfere with the overall look of the stationery. Requests for removal of copyright credits from stationery items will incur a fee at the discretion of Bluebelle Studio, payable prior to stationery being printed.
LIMIT OF LIABILITY
Maximum Damages. Client agrees that the maximum amount of damages he or she is entitled to in any claim relating to this Agreement or Services provided in this Agreement are not to exceed the Total Cost of Services provided by Bluebelle Studio.
Indemnification. Client agrees to indemnify, defend and hold harmless Bluebelle Studio and its affiliates, employees, agents and independent contractors for any injury, property damage, liability, claim or other cause of action arising out of or related to Services and/or product(s) Bluebelle Studio provides to Client.
Force Majeure. Notwithstanding the above, either party may choose to be excused of any further performance obligations in the event of a disastrous occurrence outside the control of either party, such as, but not limited to:
A natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms or infestation); or War, Invasion, Act of Foreign Enemies, Embargo, or other Hostility (whether declared or not); or Any hazardous situation created outside the control of either party such as a riot, disorder, nuclear leak or explosion, or act or threat of terrorism.
Failure to Perform Services. In the event Bluebelle Studio cannot or will not perform its obligations in any or all parts of this Agreement, it (or a responsible party) will:
Immediately give Notice to Client via email; and Issue a refund or credit based on a reasonably accurate percentage of Services rendered; and
Excuse Client of any further performance and/or payment obligations.
Governing Law. The laws of Australia govern all matters arising out of or relating to this Agreement, including torts.
Severability. If any portion of these Terms & Conditions is deemed to be illegal or unenforceable, the remaining provisions remain in full force.
At Bluebelle Studio, we respect your privacy and promise not to disclose, exchange or sell your personal details to any third party. Your personal information will remain secure and confidential and will only be used to process your order or to inform you of special offers.
These terms and conditions also apply to YOU. Our work is not to be copied, borrowed or stolen. Neither are these terms and conditions. We retain copyright to all of our work, images, text and written words and breeches of this copyright will be pursued vigorously.
We are an Australian owned and operated business. All prices are in Australian Dollars (AUD) including GST and are subject to change and availability. Sizes and designs may change over time. Bluebelle Studio reserves the right to update their pricing at any time without notice.
PAYMENT & ORDERING
ONLINE ORDERS As each job is printed on a to-order basis, full payment payment is required before work can commence on your job. 10% is a non-refundable booking fee to cover administrative costs. Our website has a secure online shopping cart through SHOPIFY. You can be assured that your personal details are treated with the utmost security and privacy.
CUSTOM & INVOICED ORDERS
Retainer. The first payment is 50% of the project cost, 10% of this is a non-refundable booking fee, FIRST PAYMENT is due upon receipt of invoice. At a minimum, Client agrees that the retainer fee fairly compensates Vendor for committing to providing the Services and turning down other potential projects/clients. If payment is delayed, the continuation of the project will also be delayed.
Payment. The Vendor will not commence work on Services until deposit has been paid by Client. The billing will reflect the actual costs incurred. If there are minor adjustments, such as quantity of invitations or number of envelopes addressed, the final payment will be adjusted. Client will be notified of any changes and will receive updated invoice. The remaining balance will be due at the time of completion. Separate projects, including but not limited to: save the dates, invitations and ‘day of’ details may be billed separately due to the accumulation of details throughout the design process. Final payment is due prior to the finished product being collected by/shipped to Client. If final payment is not received, finished product will not be shipped/collected, regardless of signed contract or estimated completion date.
CANCELLATIONS & REFUNDS
Please choose carefully. Due to the nature of our work and time involved in creating and designing our stationery, we cannot refund payment once proofs have been produced simply because you have changed your mind. If you change your mind of what you would like and we haven’t emailed you a proof yet, please email us to arrange an alternative.
A 10% non-refundable booking fee is included in the order total to cover our administration costs should you wish to cancel your order.
A PDF proof will be emailed to you for approval before printing. Once you have checked and approved your proof, your job will be sent to print. Please allow minimum 7 business days from approval of your proof to collection/delivery. (See ‘Ordering’ for timeframes). As per our Printing/Colour policy below, there may be a slight variance in colour to the proof and your final print run.
The PDF proof is sent to you to check the content. Please be aware that due to variations in monitors and also to the different print process we use, the appearance of colours and images in the finished product may vary to how they look on your screen or to prints from other sources. Client errors that are signed off through the proofing process are to be reprinted at the clients expense. It is the client’s responsibility to check all copy is correct. Ensure that all text supplied is as final as possible, we allow for two rounds of text amendments at proof stage (three rounds for custom).
GUEST LISTS & ADDRESSES
If you are having guest names on invitations, we will email you a spreadsheet template for you to fill out and email back to us. Please ensure all names typed exactly as you would like them to be spelt and written. eg. Mr & Mrs Doe, Bob and Jane Doe, Robert & Jane. And for place cards one name per line or cell, eg Bob, Jane etc.
It is important that you ensure all spelling, punctuation and spacing is correct on your guest list as our printer uses an automated system and your list will be printed exactly as supplied. Any errors supplied by clients on their lists will be reprinted at the clients expense.
Addresses will be written exactly as they appear on provided list from Client. Bluebelle Studio will not make etiquette or spelling corrections. If Client wishes Bluebelle Studio to prepare a supplementary proof list for address printing, a $30 fee will be added onto your final invoice. Please deliver the address list in an excel spreadsheet document.
Our standard pricing includes the placement of your wording/images into your chosen theme/layout, plus two rounds of text amendments at proof stage (three rounds for custom jobs). Additional amendments will be charged at an hourly rate. Alterations to your order may be made until the final proof is approved. Once approved, no alterations may be undertaken. Signed approval back to us will confirm the completion of your order.
Bluebelle Studio is committed to providing you with a flawless design process with the utmost attention to detail. If however any errors are made on behalf of Bluebelle Studio they will be reprinted free of charge. It is the client’s responsibility to supply, then check all wording and layout to ensure it is correct before signing the authorization on the final proof, if errors are found after this sign off, we will have to charge the client for a reprint.
Stationery that is printed digitally, it is possible that subtle colour variations can occur between each piece. This is not a fault of the design but a natural effect of the printing process. There can also be a colour variation between stock types because of the way the ink sits on different card stock varying in material and texture. Therefore designs printed on shimmer can have a variation in colour and look compared to those printed on smooth white card stock.
Please also be aware that due to variations in monitors and also to the different print process we use, the appearance of colours and images in the finished product may vary to how they look in the proofs on your screen or to prints from other sources. Stationery can not be refunded or returned because of normal printing effects. We take pride in the quality of our work and assure you that all of our stationery is printed to the highest professional standards. Bluebelle Studio cannot be held responsible for colour differentiation.
PLEASE NOTE: The colours shown on our printed colour palette and in our samples are a guide to the shades we have available. Due to the variable nature of the digital printing process, these colours do shift between each print run, therefore an identical match to our printed colour palette that you have received as part of a sample pack may not be achieved.
If you wish to have a specific colour, we offer ‘off-set’ printing (more costly) in which you choose a PANTONE PMS colour to replicate.
PRINT ON WOOD
Our wood invitations are REAL TIMBER. This means that no two invitations are ever the same. Each batch of timber harvested may look slightly different from the previous, even though they are the same tree type. This is due to the natural characteristics of the product.
We take great pride in the quality of our work. If you are unsure of the quality of our finished product we highly recommend the purchase of a sample prior to ordering. As above, it is possible for a variation in colour to occur between your sample pack products and your finished order. Samples printed on shimmer will also vary in colour to those printed on other stock. As each order is printed individually we can not guarantee exact colour matches to samples or swatches supplied. Sometimes we may supply samples in custom colours different to what is shown on our website - this is to give you an idea of the options available - if you would like to order in this alternative colourway please select the custom colour option at time of order, otherwise your order will processed in the standard colours shown on the website.
Orders are subject to stock availability. In the event of supply difficulties Bluebelle Studio will inform you and discuss alternative materials or designs.
WRITING ON STATIONERY
Our stationery is not designed to be put through another printer to type the names of your guests. If this is the outcome you would like please choose to have guest names printed on your order. If you are writing on the invitations it is advisable to test the pen you are planning to use first to avoid smudging and double printing. We recommend that you allow at least 5 -15 spare invitations in your order quantity to allow for errors.
POSTAGE & PACKING
Postage will be calculated at checkout. Orders are delivered by either Australia Post or Courier and will require a signature. We are not liable for any damage whatsoever caused by third parties as we take great care in packaging your order to reach you intact. Bluebelle Studio cannot be held responsible for any loss or damage in transit once the order has been dispatched. You will be supplied with a courier tracking number on the day that your package is collected from our studio so you can track your goods from door to door. Local collection from our studio is applicable.
A minimum order of 20 items per stationery piece is required. It is advisable to allow between 5 -10 spares in your order. Please contact us for specific pricing if you require a smaller quantity.
Please allow between 4-6 weeks from the proofing stage to finish of your order. It is important that you book your order in prior to payment to ensure that we are able to meet your deadline. Urgent orders may require an additional loading fee depending on scheduling and client request. We will advise if this is applicable to you. Bluebelle Studio reserves the right to turn away orders where deadlines cannot be met.
During the year we will be closed during certain periods. We will give as much notice as possible on our site as to these closure dates. Orders placed prior to and during closure dates are subject to delays, if you have any concerns re the timing of your order please contact us via email firstname.lastname@example.org prior to ordering. Orders placed during closure dates will be attended to in order of receipt on our return. If we cannot meet your deadline we will advise before we commence work on your job. Delivery times quoted as an approximate and depend on the speed in which you supply information to us and approve your proofs.
We can only accept images for baby cards/invitations/photo thank you cards via email. Please ensure digital images have been taken at the highest mega pixel setting and size on your camera. Please do not post hard copy images or photos as we cannot use them. Bluebelle Studio will examine your images upon receipt and advise to the best of our ability if they are suitable enough quality to print from.
Bluebelle Studio reserves the right to refuse to use images that are not of suitable quality or offensive in nature.
Please be aware that printed images may differ in colour, darkness/lightness and quality to that of prints from other sources/print methods and to that of how they appear on your screen. This is due to the different printing process and technique that is used to create our stationery. Bluebelle Studio will not be responsible for variations in colour/quality due to our printing processes, or for flaws in the image that you have supplied.
OWNERSHIP OF PHOTOGRAPHY
By supplying images to Bluebelle Studio for use in stationery, you certify that;
1. You are the parent or guardian of the baby or child, or have obtained the consent of the parent or guardian to use the photos provided.
2. You have the rights to use any information and / or pictures supplied by yourself. Professional images that are provided to you by a professional photographer may be protected by copyright laws and cannot be reproduced without permission from the photographer.
By supplying images to Bluebelle Studio you agree to hold harmless and to indemnify Bluebelle Studio and its agents, for all liability, damages, and expenses it may incur as a result of processing and printing copy written photographs and reproductions, including any other person claiming an interest in the photos. Bluebelle Studio reserves the right to refuse to use images and cancel your order if we suspect the images may infringe on someone else’s copyright.
ACCEPTANCE OF TERMS, CONDITIONS AND DISCLAIMERS
Our website is owned and operated by Bluebelle Studio (ABN 28 239 228 024).
By accessing or using our website or enquring about our services, you agree to these terms and conditions (“Terms & Conditions”) and acknowledge and accept the disclaimers and that you have read and understood these Terms and Conditions. The site and its contents are provided to you on an “as is” basis, the site may contain errors, faults and inaccuracies and may not be complete and current.
Bluebelle Studio makes no representations or warranties of any kind, express or implied as to the operation of this site or the information, content, materials or products included on this site, except as otherwise provided under applicable laws.
Bluebelle Studio, nor its affliates, directors, officers, employees, agents, contractors or assigns will be liable for any damages whatsoever arising out of, or in any way related to, the use of our site and any other site linked to this site. This limitation applies to direct, indirect, consequential, special, punitive or other damages you or others may suffer, as well as damages or loss of profits, business interruption or the loss of data information.
Bluebellestudio.com.au cannot guarantee that any file or program available for download and/or execution if free from viruses or other conditions. You assume all risk of use of all programs and files on this site, and you release First Love Boutique entirely of all responsibility for any consequences of its use.
By purchasing a product or service from Bluebelle Studio or our website and/or by completing the registration process, you expressly agree to be bound by these Terms and Conditions.
